Who owns what, and what to do if you believe something on Magemcy infringes your rights.
On this page 7 sections
Your content is yours
You keep all rights in the data and documents you put into Magemcy, vendor records, tender documents, bids, purchase orders, invoices, logos, everything. We claim no ownership of it.
You grant us only the licence we need to run the service for you: to host, store, copy, transmit, display and process your content so the product works, and to make backups. That licence is non-exclusive, exists only for as long as you use the service, and ends when you delete the content or your account.
We do not use your content to train AI models, and we do not licence it to anyone else. Where you deliberately publish something, a marketplace profile, say, the licence extends to displaying it publicly, because that is the point of publishing it.
Our software and brand
The Magemcy platform, its software, design, text, the knight, and the arrangement of it all, is owned by Magemcy and protected by copyright and other laws. Your subscription is a limited, non-exclusive, non-transferable right to use the service, not a transfer of any of it.
“Magemcy”, the Magemcy logo and the knight mascot are our marks. You may refer to Magemcy by name, for instance to say that you use it, but you may not use our marks in a way that suggests endorsement, partnership or affiliation without our written permission, and you may not use them in your own product, domain or company name.
Third-party components are used under their own licences, which are respected and unaffected by anything here.
Feedback
If you send us a suggestion, we may use it to improve the product without obligation or payment. That is not a claim on anything else you own, it applies to the suggestion itself, so that a good idea does not become a legal problem. We will not identify you as its source without asking.
AI output
As between you and us, output an assistant produces in response to your input is yours, subject to the underlying provider’s terms (Google for the Gemini API, or OpenAI when it answers as the fallback). Bear in mind that AI output may not be copyrightable in every jurisdiction, and may resemble output given to someone else who asked a similar question. Do not rely on it being unique, and check it before relying on it at all, see AI disclosure.
Copyright complaints
If you believe material on Magemcy infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent including:
- Your physical or electronic signature.
- Identification of the copyrighted work you say has been infringed.
- Identification of the material you say is infringing, specific enough for us to find it.
- Your contact details, address, telephone and email.
- A statement that you believe in good faith the use is not authorised by the owner, its agent, or the law.
- A statement that the information is accurate and, under penalty of perjury, that you are the owner or authorised to act for them.
We will act on valid notices, which usually means removing or disabling access to the material and telling whoever posted it.
Please be careful before sending one. Misrepresenting that material is infringing carries liability for damages under 17 U.S.C. § 512(f), and much of what sits in a procurement system was put there legitimately by someone who has the right to it.
Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice with your signature, identification of the material and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake, and your consent to the jurisdiction of the federal court for your district (or, if outside the United States, of our jurisdiction).
We may restore the material in 10 to 14 business days unless the original complainant tells us they have filed a court action.
Repeat infringers
We terminate the accounts of repeat infringers in appropriate circumstances, as the law requires.
Trade mark and other infringement complaints go to the same address: our legal contact.
